Your May 21 response is similar to Ms. Boyte’s May 20 response. In reply to both your May 21 response and Ms. Boyte’s May 20 response: The number the State Attorney’s Office Office has assigned to GC-CARE’s third request (01PR-2020-0931-A) suggests your office is treating this third request as coterminous with GC-CARE’s first request. It is not coterminous. It is a separate and distinct request. It is orders of magnitude more limited in scope then the first request. Rather than simply providing what GC-CARE requested in its limited third request (5/21/2020)— the first four pages depositions in the referenced Criminal Case — your office responded:  (5/20): “As specified, your request will require a large number of hours to research and identify the specific items.”   and (5/21): “This is a voluminous file containing many records some of which (financial records) require significant redaction. This will result in significant cost to you as requester. I want to let you know that you have that option, either now, or after you receive the estimate to go over the type of records in the file with me.” (SIC) Please appropriately respond to GC-CARE’s very limited third public records request.  Please send the records in response to this third response by the end of business today.

Dear Sir or Madam:

We are in the process of developing an estimate for the review and redaction of the public records that you have requested. This is a voluminous file containing many records some of which (financial records) require significant redaction. This will result significant cost to you as the requestor. I want to let you know that you have that option, either now, or after you receive the estimate to go over the type of records in the file with me. This would give you the opportunity to decide to modify or re-order your request to obtain the public records that interest you the most, the quickest, and with the least expense. You are not required to limit your request, we just don’t want you to get an estimate for a large amount and feel that this is an effort to prevent you from obtaining the records you want. It is not, and we try to reach out to any requestor who is receiving an estimate as high as this. We are happy to work with you in any way reasonably possible to get the records that you want in the most expeditious and economical fashion.

Regarding your most recent request, please also be aware that we do not have any deposition transcripts in this file. It appears likely that depositions were taken. This office normally does not order deposition transcripts unless there is a specific need to do so.

You do not need to be physically present in the office to review the file with me. We can do this on the phone or by video teleconference.
